Privacy Statement
McMahons Lawyers (McMahons) deals with the collection,
security, quality, use and disclosure of personal information in accordance
with the Privacy Act 1988 (Cth) and the National Privacy Principles
contained in Schedule 3 to that Act.
Collection, Use and Disclosure of Personal Information in Relation to
Clients
Information provided to McMahons in relation to McMahons individual
clients and corporate clients employees will be used by McMahons
for marketing purposes, such as the distribution of newsletters, the
invitation of clients to seminars or sporting or social functions, and
similar marketing activities.
Such information may be disclosed to third parties from time to time,
but only in conjunction with McMahons marketing activities.
It is not likely to be practicable for McMahons clients and their
employees to deal with McMahons anonymously.
However, if at any time you would like to have your personal information
removed from McMahons marketing database and mailing list, please
forward such a request to the Privacy Officer in writing or by email.
Collection, Use and Disclosure of Personal Information in Relation to
Others
Information provided to McMahons in relation to individuals involved
in legal matters being handled by McMahons will be used by McMahons
for all purposes necessary to conduct the particular matter on behalf
of the client. Personal information collected in relation to matters
being handled by McMahons may include sensitive information, for example
health information, depending upon the nature of the particular matter.
Such information may, from time to time, be disclosed as necessary to:
- The client on whose behalf the matter is being handled;
- Experts appointed by McMahons, such as doctors, investigators, loss
adjusters, accountants and other forensic experts;
- Barristers briefed to advise and/ or appear in the particular matter;
- The Health Insurance Commission and the Department of Social Security;
- The Court;
- Other parties to the matter and their solicitors;
- Other entities as may be appropriate given the particular circumstances
of the matter or as may be required by law.
Given that such personal or sensitive information will be obtained by
McMahons in the course of conducting litigation and/ or providing legal
advice to McMahons clients, it will not always be practicable
for such information to be collected directly from the individual to
whom it relates. Such information will be collected by lawful and fair
means, in accordance with usual practices in the industry.
It is not likely to be practicable for individuals in respect of whom
McMahons collects personal or sensitive information in relation to legal
matters being handled by McMahons to deal with McMahons anonymously.
Access to Personal Information Held
in Relation to Clients
An individual client or an employee of a corporate client has the right
to request McMahons to provide him or her with access to personal information
held in relation to him or herself. He or she also has the right to
request the correction of any information which relates to him or her
and which is inaccurate. Any corrections should be advised to the Privacy
Officer in writing or by email.
Access to Personal Information Held
in Relation to Others
Given the circumstances in and purposes for which information is collected
by McMahons in relation to legal matters being handled on behalf of
clients, it will not always be practicable for the individual concerned
to be given access to the information held by McMahons in relation to
him or her. Often, such information will be protected by client legal
privilege.
